IPNEWS: On Friday, August 28, Liberia’s Supreme Court officially rejected the petition filed by former House Speaker Cllr. J. Fonati Koffa and his co-defendants, clearing the way for their high-profile Capitol Building arson trial to resume.
Chief Justice Yamie Quiqui Gbeisay Sr. handed down the critical ruling, which seems to have resolved a tense legal standoff regarding how the lower court handled the case. The ruling sighted that the defense team had filed a petition for a writ of prohibition challenging the decision made by Judge Roosevelt Z. Willie of Criminal Court “A” to disband the trial jury and declare a mistrial.
Lawyers for the former Speaker also argued that disbanding the jury was legally unjustified and prejudiced the defendants’ constitutional rights. They had successfully obtained a temporary stay order to halt the case until the high court weighed in.
By throwing out the defense’s challenge, the Supreme Court has now validated the judicial authority to dissolve the jury under those circumstances, meaning the stay order is lifted and the full trial will proceed at Criminal Court “A”.
However, the on the flipside, legal pundits view the ruling as an infraction of ‘Double Jeopardy’ that the very constitution the supreme court seeks to protect.
Under Liberian law, double jeopardy is a constitutional right that protects a person from being tried or punished twice for the same offense.
Article 21 of the constitution of Liberia explicitly states that “no person shall be subject to double jeopardy”.
Section 3.1 of the Liberian Criminal Procedure Law makes the doctrine applicable to all criminal prosecutions.
What happens When Double Jeopardy Attaches
Under Liberian law, jeopardy begins (or “attaches”) at a specific point in a criminal proceeding: When a person is put on trial before a competent court under a valid indictment, has been arraigned, has entered a plea, and a proper jury has been impaneled and sworn. When the court begins hearing evidence in a bench trial.
Defense lawyers argued that the trial judge must conduct an investigation by suspending the case before disbanding a jury which was never carried out.
Defense Lawyers content that the “Double Jeopardy” and Fair Trial Protections, was never respected in accordance with earlier ruling by the Supreme Court that the original jury was dismissed improperly after being sworn in, it could raise constitutional bars against retrying them under double jeopardy principles, or severely compromise the legality of the prosecution’s parameters when the Supreme Court of Liberia has scheduled a definitive ruling regarding this jury dispute.
A victory for the defense on this front could paralyze the prosecution’s case or lead to a mistrial.
Once the trial resumes and the prosecution finishes presenting its witnesses, the defense has the right to file a Motion for a Judgment of Acquittal before the case even goes to a jury deliberation, however, if the trial judge determines that the state’s case relies entirely on political suspicion or unverified police links—without proving that Koffa and his team physically purchased or strategically deployed the explosives—the judge can dismiss the charges directly.
Legal pundits further argued that the primary legal pathways and arguments that could lead to dismissal of the case would include, a mistrial, or a dropping of the charges in the Capitol Building arson case include the exploiting weakness and gaps in forensic evidence which is a core defense strategy for acquittal relies on the “glaring deficiencies” in the prosecution’s forensic evidence.
Another issue that may cause the dismissal of the case, is lack of direct physical links.
During testimony, a Liberia National Police investigator admitted under oath that authorities failed to conduct fingerprint analysis on the primary items allegedly used to start the fire—specifically a Clorox bottle and a matchbox found at the scene.
The Failure to Prove Guilt Beyond a Reasonable Doubt could also be a legal basis for dismissal of the case.
While the lower court initially ruled that there was enough circumstantial evidence to suspect involvement (establishing a prima facie case), the standard for a criminal conviction in Criminal Court “A” is much higher. If the defense can show that the lack of forensic matching creates reasonable doubt, the jury or judge must legally acquit the defendants.
Violations of Due Process Regarding the Jury (Constitutional Arguments), especially when the trial is currently frozen due to a major constitutional dispute regarding how the jury panel has been handled.
Furthermore, the defense has argued that the trial judge, Roosevelt Z. Willie, acted unconstitutionally by removing a seated juror based on political affiliations and later seeking to completely disband the empaneled jury.
Another argument that would satisfy a dismissal of the case is after the fire occurred immediately following a highly contentious, polarized attempt to remove Koffa from his position as Speaker of the House. The defense has continually argued that the arson charges lack an actual legal basis and are politically weaponized.
If defense can demonstrate that the timing and allegations are entirely circumstantial fabrications intended to damage Koffa’s faction, they can dismantle the prosecution’s narrative of criminal intent.
Alongside former Speaker Koffa, the high-profile case implicates several sitting lawmakers: Representative Dixon W. Seboe, Representative Abu B. Kamara, and Representative Jacob C. Debee.
The lawmakers face severe criminal charges, including arson, criminal mischief, attempted murder, conspiracy, and economic sabotage.
The charges stem from a massive December 2024 fire that tore through the Capitol Building in Monrovia. The blaze broke out immediately following aggressive political protests and a chaotic campaign to remove Koffa from his position as Speaker. Police estimates placed the physical property damage at $8.6 million USD.
