    Supreme Court Orders Back Pay for Rep. Yekeh Kolubah

    The supreme court of Liberia ordered the leadership of the House of Representatives to make back-payment of salaries of June 2021, for controversial Montserrado county District#10 Representative Yekeh Kolubah.

    The High court said the refusal of the house leadership to pay the lawmaker his salary and benefits for the month of June ,2021 is a violation of the mandate of the justice in Chamber for which the lawmaker lawyers filed a bill of information.

    However, the supreme court have issued a peremptory writ on the leadership of the house of representatives.

    A peremptory writ of mandate, also known as mandamus, is a court order that requires a government official, body, or lower court to perform an act that is required by law. It is a final order, and is issued when a government agency or official does not comply with an alternative writ of mandate.  A peremptory writ may be issued in the following circumstances: 

    Emergency: If there is an emergency, the court may issue a peremptory writ without an alternative writ.

    No reason not to follow the law

    If there is no good reason for the government not to follow the law, the court may issue a peremptory writ without an alternative writ.

    A peremptory writ is similar to an alternative writ of mandate, but the alternative writ gives the government a chance to explain why they can’t follow the order. The alternative writ usually requires the government to either perform the required action or show cause why they shouldn’t. 

    An example of when a peremptory writ might be issued is if a citizen petitions the court to order a government agency to release public records.
