    Liberia: Judiciary Moves To Enforce Supreme Court Mandate In Diamond Dispute

     IPNEWS: A renewed commitment to upholding the rule of law is taking center stage as the Sixth Judicial Circuit Court in Montserrado County has directed decisive action to enforce a mandate of the Supreme Court of the Republic of Liberia in connection with the ongoing diamond dispute involving stakeholders in Smith Town, Gbarpolu County.

    By directive of His Honour J. Boima Kontoe, Assigned Circuit Judge of the Sixth Judicial Circuit Court, Montserrado County, the Solicitor General of Montserrado County, Cllr. Augustine C. Fayiah, has been formally ordered to utilize all necessary legal measures to enforce the judgment of the Supreme Court.

    The mandate specifically calls for the arrest and detention of Mustapha Tounkara, President of the Diamond Dealers Association of Liberia, in relation to the case styled

     In Re: Mr. Mustapha Tunkara, President of the Diamond Dealers Association of the City of Monrovia, Liberia  Informant versus His Honour J. Boima Kontoe, Assigned Circuit Judge, Sixth Judicial Circuit, Civil Law Court, Montserrado County, Liberia; T. David Sluward and Abraham Kamara, Holders of Class “C” Mining License, et al., Agency Claim, Gbama District, Gbarpolu County, Liberia  Respondents.

    The matter stems from a long-running legal contest involving the Ministry of Mines and Energy, its deputies and directors, the Diamond Dealers Association of Liberia, and licensed mining operators in Gbama District, Gbarpolu County.

    Court’s Seal and Authority

    The mandate, issued under the seal of the court and signed by Clerk of Court Victor G. Gailor on February 27, 2026, underscores the judiciary’s determination to ensure that its rulings are respected and executed in accordance with Liberian law.

    Legal observers note that the enforcement directive demonstrates the courts’ unwavering authority in matters involving natural resource governance and affirms the supremacy of judicial decisions in resolving disputes.

    Gbarpolu Residents Express Confidence in Justice Process

    Meanwhile, residents and traditional leaders of Smith Town in Gbarpolu County have expressed optimism that the enforcement of the Supreme Court’s mandate will restore clarity and stability to the diamond sector in their region.

    Community leaders have long maintained that proper enforcement of the Court’s ruling is essential to strengthening transparency and accountability in the management of local diamond resources. 

    According to them, lawful and structured mining activities hold significant promise for economic revitalization in Smith Town and surrounding communities.

    Local elders emphasized that responsible diamond operations could generate revenue to improve schools, healthcare facilities, roads and other essential social services in an area that continues to face development challenges.

    “Our hope is that the mandate will now be fully implemented in keeping with the law,” one traditional leader stated. 

    “We believe in the justice system and trust that the Ministry of Justice will act in accordance with the Supreme Court’s decision.”

    National Attention on Ministry of Justice, all eyes are now on the Ministry of Justice as it moves to carry out the court’s directive. Residents say they are encouraged by recent developments and expect swift action in keeping with Liberia’s constitutional framework.

    Citizens have also called on the Minister of Justice and Attorney General of the Republic of Liberia, Cllr. N. Oswald Tweh, to ensure that the enforcement process is handled professionally, transparently, and in strict adherence to the law.

    Observers say that decisive enforcement of the Supreme Court’s mandate would send a strong signal that Liberia remains committed to judicial independence and the sanctity of court rulings, particularly in sectors as sensitive and economically vital as mining.

    Strengthening Governance and Investor Confidence

    The Smith Town diamond case has drawn national attention due to its broader implications for natural resource governance in Liberia.

     Analysts argue that consistent enforcement of court decisions strengthens investor confidence and enhances Liberia’s image as a country guided by the rule of law.

    As Liberia continues to position itself as an attractive destination for responsible investment in mining and other sectors, the effective implementation of judicial mandates is widely seen as a cornerstone of sustainable development.

    Residents of Gbarpolu County have reiterated their commitment to peace and lawful engagement, stressing that their primary interest is the fair and transparent management of their natural resources for the benefit of present and future generations.

    With the judiciary having spoken and enforcement measures underway, many Liberians view the latest development as a positive step toward reinforcing accountability, restoring public trust, and ensuring that justice is not only pronounced but fully realized.
