…As Supreme Court Issues Writ of Prohibition on Executive Branch.
IPNEWS: The Supreme court of Liberia has issued a writ of Prohibition over President Boakai’s recent decision to Dismissed the Director General of the Public Health Institute of Liberia (NPHIL),Dr. Christopher Nyan, and his Deputy Adam Lincoln.
In a writ of Prohibition, Justice in chambers, Her Honor Jamesetta H. Wolokollie, Associate Justice presiding granted a petition filed by Cllr. Tiawon Saye Gongloe, of the Gongloe and Associates Inc. and cited the parties Dr. Christopher Nyan as Petitioner and the Executive Branch of government represented by the Ministry of Justice, to a conference slated for Thursday, November 13,2025@3:30 P.M.
In his petitioned. Nyan, states that as the duly appointed and tenured Director General of the National Public Health Institute(NPHIL), a statutory autonomous agency established by an Act of the Legislature, provides that the Director General shall serve a fixed term of five years and may only be removed for cause, including corruption, conviction, incapacity, or conduct inimical to public interest and only after due process.
Dr. Nay argues that before his purported removal, he submitted a response to the office of President Boakai dated September 17, 2025, refuting all allegations by the Board and demonstrating full compliance with law and policies.
He also argued that there was no formal charges consistent with any violation in keeping with the provision of the Act for his removal.
“Nevertheless, the president issued the termination letter without any hearing or findings, in violation of the administrative procedure Law of Liberia and the commanding expression of chapter III, article 20(A) of the Liberian constitution.
Dr. Nyan’s petition further prayed that the Supreme Court issue an order to the Government of Liberia and all its agents and assigns from enforcing his removal until a conference would have been conducted and determined the legal property of the government of Liberia.
Furthermore, Dr. Nyan prayed that upon finding that President Boakai action is unsupported by laws of the Land, declare said termination illegal, unconstitutional, and void ab initio, same violating the NPHIL Act of 2016, the administrative procedure law and judiciary law, and Article 20(a) of the q986 constitution.
Additionally, Dr. Nyan prayed the Supreme Court to order his immediate reinstatement as Director General.
The petition furthermore prayed for return of the parties to status quo ante pending the disposition of petition and grant such other and further relief as the Supreme Court deem just, legal and equitable in the premises.
President Boakai dismissed Dr. Dougbeh Chris Nyan, the Director General of the National Public Health Institute of Liberia (NPHIL), based on a formal recommendation from the NPHIL Board of Directors citing “gross inefficiency,” “undesirable actions against the public interest,” and violations of the NPHIL Act of 2016.
The dismissal, which took effect in October 2025, sparked controversy, with Dr. Nyan labeling the allegations as “baseless, vague, and politically motivated” and challenging his removal in court.
The NPHIL Board’s resolution included seven counts contrary to ealier report of 11 counts of alleged misconduct, such as:
- Lack of coordination with the Ministry of Health and other agencies.
- Procedural breaches in travel and administrative decisions.
President Boakai also dismissed the Deputy Director General for Administration, Dr. Adams K. Lincoln, following an investigation that recommended his dismissal for allegedly orchestrating the unauthorized removal and illegal sale of eleven NPHIL vehicles.
President Boakai has since appointed Dr. Sia Wata Camanor as the Interim Director General of NPHIL.
